Terms and conditions
Terms and conditions – HS Bílaréttingar og sprautun ehf. This is a translation of the Icelandic terms; the Icelandic version applies.
01General
- These terms apply to all services provided by HS Bílaréttingar og Sprautun ehf. (hereafter “the workshop”) to its customers, including damage assessment work, vehicle repairs, storage of vehicles and other incidental work.
- By handing a vehicle over to the workshop, the customer accepts these terms in full.
02Work orders, damage assessment and bookings
- Preparatory work on a damage assessment begins when the customer brings the vehicle to the workshop for a damage inspection, unless otherwise agreed.
- The cost of the damage assessment itself corresponds to one (1) hour at the applicable hourly rate, plus VAT.
- In the case of an insurance claim, this cost is paid by the insurance company concerned.
- Final work on the damage assessment and the ordering of parts does not begin until the customer, or the insurance company on the customer's behalf, has approved the cost estimate in writing or in another demonstrable manner.
- Cost estimates are issued for each job so that the purchaser of the service has an indication of the price of the work in question.
- If it emerges after work has started that the required repairs exceed what was estimated, the workshop reserves the right to revise the estimate.
- If it is foreseeable that the price will increase substantially from the issued estimate, the workshop will notify the consumer without delay and request the consumer's approval to continue the work on the basis of a new estimate. If such approval is not given, the consumer is entitled to have the vehicle released against payment for the work already carried out.
- Booking depends on the workload at the workshop and on parts availability from the importers at any given time.
- Estimated repair time is given for guidance and is based on the workshop's capacity and access to parts at the time the estimate is made.
- The workshop endeavours to complete work within a reasonable time and will inform customers of any foreseeable delays. The workshop is not liable for delays caused by unforeseeable circumstances beyond its control, including shortages of parts.
- All requests to change a booking must be made by telephone or to the email address tjonaskodun@hsretting.is.
- If a customer does not bring the vehicle in for repair at the specified time without rescheduling or giving at least 24 hours' notice, the workshop reserves the right to charge a labour fee corresponding to one (1) hour at the applicable hourly rate, plus VAT, in the case of a private job. For insurance claims, this cost is borne by the insurance company concerned.
03Modified vehicles and non-original parts
- If a vehicle has been modified from the manufacturer's original condition with accessories, cosmetic changes or similar, the workshop reserves the right to decline the job without further explanation.
- If the workshop accepts such a job, its liability extends only to the work it carries out itself on the vehicle and to the materials it supplies and/or selects itself. If a defect can be traced to a part that the customer specifically required or supplied, the workshop is not liable for that defect, provided the workshop made this clear to the customer in advance.
04Parking and liability
- Vehicles parked in the car park of HS Bílaréttingar og Sprautun ehf. are there at the risk of their owners and keepers.
- The workshop is not liable for damage that may occur to vehicles handed over to it, unless the damage can be traced to negligence on the part of the workshop.
- Once the customer has been informed that the vehicle is ready, the owner is responsible for it in the car park.
- The workshop accepts no liability for personal belongings left in vehicles.
05Payment
- Invoices are to be paid in accordance with the terms stated on the workshop's invoices.
06Law and jurisdiction
- These terms are governed by Icelandic law. Where provisions of these terms depart from consumer rights under Act No. 42/2000 on service purchases, the provisions of the Act take precedence.
- In the event of a dispute regarding the workshop's services, consumers may refer the matter to the Icelandic complaints board for goods and services or to the courts. Court proceedings shall be brought before the District Court of Reykjavík.
